Terms and conditions of sale
1.0 Introduction
1.1 Definition of terms.
1.2 Please read these terms and conditions carefully before using this website to purchase products ("Products"), book events ("Events"), make donations ("Donations") and/or pay tuition, accommodation or other fees ("Fees"). By using this website to purchase Products, book Events, make Donations and/or pay Fees you agree that these terms and conditions apply.
2.0 Contract terms
2.1 By ordering Products, booking Events, making Donations and paying Fees using this website you confirm either:
- that you are doing so in your personal capacity and that you accept that these terms and conditions will apply; or
- where you are ordering a Product, booking an Event, making a Donation or paying Fees in the name of another individual, a partnership, company or other legal entity, that you have the right and authority to do so and to accept these terms and conditions on behalf of such individual, partnership, company or other legal entity.
3.0 Ordering Products
3.1 It is your responsibility to ensure that all details of each order you place are complete and accurate.
3.2 Each order will be an offer by you to purchase Products subject to these terms and conditions. The Institute will not be bound to supply any Products ordered until it has accepted the order by email or otherwise notified its acceptance to you. The Institute is entitled to reject any order and, if it does so, it will notify you.
4.0 Booking Events
4.1 It is your responsibility to ensure that all details of any Event booking are complete and accurate.
4.2 Each booking will be an offer by the delegate to attend the Event subject to these terms and conditions. The Institute will not be bound to permit attendance at any Event booked until it has accepted the booking. This will be in the form of a confirmation e-mail. Before this time the Institute reserves the right to cancel, reject or abort any booking made. In any such case, if payment has already been received, a full refund will be made.
5.0 Prices and payment for Products and Events
5.1 The price for a Product or an Event is the price in force on the date and at the time of ordering and/or booking. The Institute tries to ensure that the prices displayed on this website are accurate but prices are subject to validation by the Institute as part of its acceptance procedure. The Institute will inform you prior to acceptance of your order and/or booking if the correct price of a Product or an Event is higher than that stated in your order and/or booking and in such a case you may cancel the order and/or booking if you wish.
5.2 Payment for the total cost of the Product and/or Event together with any applicable delivery charges must be made by credit or debit card at the time of order and/or booking. Any credit or debit card used to purchase Products and/or to book Events must belong to you or be used with the consent of the owner and there must be sufficient funds or credit available to cover the cost of any Products and/or Events. The Institute reserves the right to obtain validation of any credit or debit card details or verification of the authenticity and ownership before accepting any order or supplying any Products or accepting any bookings for Events.
6.0 Delivery of Products
6.1 Once an order has been accepted by the Institute, the Institute will aim to deliver the Products by the date stated in the Institute's acceptance of order or, if no date is stated, within a maximum of 30 days beginning with the day after the date of your order. The Products will be delivered to the place specified in the order.
6.2 All times or dates for delivery stated on this website are estimates only. The Institute will make all reasonable efforts to deliver Products within the time specified but does not accept liability for any failure to deliver within that time.
7.0 Returns of Products
7.1 If the Product delivered is not as you ordered, or is not of satisfactory quality or fit for any particular purpose specified on this website, the Institute will at its option deliver a replacement Product or refund to you the price paid and your reasonable costs of returning the Product.
7.2 Save as set out above, Products may be returned within 14 working days commencing the day after delivery. To return Products, you must notify the Institute in writing (by post, e-mail or fax at the addresses and/or number given in the confirmation e-mail) within such period of 14 working days and you must arrange for and pay the cost of returning the Products to the Institute. The Institute will refund the sum that you paid for the original supply and delivery of the Products as soon as possible, but in any event within 30 days of you notifying the Institute that you are returning the Products. If so requested, the Institute may collect Products being returned but the cost of collection will be charged to you and may be deducted from any refund given.
7.3 All Products which you intend to return must be kept in good condition whilst in your possession.
7.4 Where the returns policy in respect of a Product differs from the terms stated above, this will be made clear prior to ordering.
8.0 Cancellations and refunds of Event bookings
8.1 Delegates may cancel bookings for Events at any time prior to the relevant Event by notifying the Institute by email or post. Delegates will be entitled to a refund if they notify the Institute of cancellation within 7 working days after booking the Event provided that the Event has not yet taken place.
8.2 The Institute reserves the right to alter the agenda of any Event due to circumstances beyond its control without being obliged to refund delegates.
8.3 Occasionally, Events are cancelled or postponed by the speakers. In these circumstances delegates will be entitled to a full refund or to attend the rescheduled Events (subject to availability). The Institute will use reasonable endeavours to notify delegates of the cancellation or postponement of an Event. However, the Institute does not guarantee that delegates will be informed of such cancellation before the date of the Event.
8.4 In order to claim a refund, delegates should write to the Institute (by fax, e-mail or post). For accounting purposes this must be received within 28 days from the date of the cancelled Event. The Institute may be unable to provide a refund if details are provided after this date. This does not affect your statutory rights.
8.5 Where the cancellation and refund terms in respect of an Event differ from the terms stated above, this will be made clear prior to booking.
9.0 Attendance at Events
9.1 If delegates have any special dietary or other health related requirements, the Institute will normally be able to accommodate their needs. Please detail any specific requirements when booking.
9.2 The Institute reserves the right to refuse admission or to require a delegate to leave an Event if their behaviour is considered disruptive, likely to cause damage, nuisance, offence or injury, is in breach of venue rules and regulations or these terms and conditions, or is otherwise unacceptable. The Institute may on occasion have to conduct security searches to ensure the safety of delegates and the venue. The unauthorised use of photographic and recording equipment is prohibited. Mobile phones must be switched off during the Event.
9.3 Occasionally Events are filmed. Delegates attending such Events consent to filming and sound recording as members of the audience. These recordings may be distributed to the public via on-demand video archives on this website.
10.0 Making Donations
10.1 When making a Donation it is your responsibility to make sure that the amount of your donation is correct.
10.2 Donations will only be refunded to you at the absolute discretion of the Institute.
10.3 The Institute is not responsible for any dissatisfaction you may have regarding the Institute's use of any donation you may make through the website. The Institute reserves the right to use your donation for its general purposes. The Institute cannot guarantee that funds will be earmarked for a particular purpose, unless specifically stated by the Institute.
11.0 Payment of Fees
11.1 Fees are payable in accordance with invoices issued by the Institute. You may pay certain Fees through this website using your student registration number.
11.2 Please refer to the terms and conditions relevant to the particular Fee for further information about cancellation and refund rights and the ways in which payment may be made.
11.3 You will receive an automatic acknowledgement e-mail following completion of any payment of Fees using this website.
12.0 Warranties
12.1 The Institute warrants that the Products will correspond with their descriptions as set out on this website and, save to the extent that any defects are drawn to your attention before acceptance of your order, will be of satisfactory quality.
12.2 The Institute gives no warranty that making the Products available in any particular jurisdiction outside the United Kingdom is permitted under any applicable non-United Kingdom laws or regulations. Accordingly the Products or any part of them are not offered for sale in any jurisdiction or to any customer where making those Products available is prohibited, whether by reason of nationality, residence, age or otherwise. If you are resident outside the United Kingdom you must satisfy yourself that you are lawfully able to purchase the Products.
12.3 All other express or implied terms, conditions, warranties or representations whatsoever with regard to the Products and/or Events, use of Donations and/or Fees, this website or any information provided by the Institute through this website are excluded to the fullest extent permitted by law.
13.0 Exclusions and limitations of liability
13.1 Nothing in these terms and conditions shall exclude or restrict the liability of the Institute for death or personal injury resulting from negligence or for fraudulent misrepresentation or in any other circumstances where liability may not be so limited under any applicable law.
13.2 Subject to the paragraph above, the Institute shall not be liable, whether in contract, tort, negligence, breach of statutory duty or otherwise for loss of data, profit, revenue, use, business, anticipated savings, goodwill, reputation or opportunity, financial or economic loss or any indirect or consequential loss or damage, costs or expenses whatsoever or howsoever arising out of or in connection with any Event, the sale and supply of Products or the purchase or attempted purchase of the Products by persons in jurisdictions outside the United Kingdom or the making of any Donation or the payment of any Fee. Furthermore delegates attend Events at their own risk and the Institute does not accept any responsibility for any loss of or damage to personal property or any personal injury resulting from attendance at any Event save as expressly set out above.
13.3 Subject to the two paragraphs above, the total liability of the Institute, whether in contract, tort, negligence, breach of statutory duty or otherwise, for any loss or damage, costs or expenses arising out of or in connection with:
- any Event, shall not exceed an amount equal to the face value of the delegate fee paid for the Event concerned; and
- the sale and supply of any Product or the making of any Donation or the payment of any Fee, shall not exceed the amount paid for the Product concerned or the amount of the Donation or Fee paid as appropriate.
13.4 If the limitation on the Institute's liability set out in the preceding paragraph is adjudged to be unreasonable in the circumstances, the limit of the Institute's liability shall be increased to the amount that the Institute can recover from its insurer for the loss in question.
14.0 General
14.1 The failure or delay by either party to exercise or enforce any right or remedy under these terms and conditions shall not operate as a waiver of that right or remedy.
14.2 These terms and conditions together with the Institute's website terms of use and privacy policy, any order form, any payment method instructions or any order acknowledgement, constitute the entire agreement between the Institute and you with respect to the purchase and supply of the Products and the booking of any Event.
14.3 The Institute will not be deemed to be in breach of these terms and conditions or held liable to the customer for any delay in performance or failure to perform any of its obligations to the customer to the extent that such delay or non-performance is due to any cause beyond the Institute's reasonable control.
14.4 No person who is not a party to the contract between the Institute and you shall have any right to enforce any term or condition of it.
14.5 If any provision or term of these terms and conditions shall become or be declared unlawful, invalid or unenforceable, in whole or in part, for any reason whatsoever, such provision or term or such part of it shall to that extent be severed from the remaining terms and conditions and deemed to be deleted from them as far as possible without modifying or affecting the legality, validity or enforceability of the remaining terms and conditions, which will remain in full force and effect.
14.6 These terms and conditions shall be governed by and construed in accordance with English law and any dispute arising out of the supply and purchase of the Products shall be subject to the exclusive jurisdiction of the English Courts.
